INDEMNITY FORM

Effective Date: 22 October 2026

At Little Mess Makers, we aim to provide a fun, safe and engaging sensory-play experience for children. By booking and participating in our sessions, parents and legal guardians acknowledge and agree to the following conditions.

1. Parental Supervision

All children must be accompanied and actively supervised by a parent or responsible adult throughout the session. Little Mess Makers does not provide childcare or individual child supervision.

2. Acknowledgement of Risks

Sensory and messy-play activities may involve water, paint, sand, foam, food-based materials and other sensory products.

Parents acknowledge that participation carries potential risks, including slipping, falling, skin irritation, allergic reactions, choking or accidental ingestion of materials.

Parents must ensure their children participate in activities appropriate for their age and abilities and follow all safety instructions.

3. Allergies and Medical Conditions

Parents must notify Little Mess Makers of any known allergies, sensitivities or relevant medical conditions before participation.

Although we aim to use child-friendly and predominantly taste-safe materials, we cannot guarantee that all materials are allergen-free or suitable for consumption.

4. Clothing and Personal Belongings

Messy play may result in stained or damaged clothing. Parents are encouraged to dress children in older, comfortable clothing.

Little Mess Makers is not responsible for ordinary staining or damage arising from participation, except where liability cannot lawfully be excluded.

5. Indemnity and Liability

By accepting this agreement, the parent or legal guardian acknowledges the ordinary and reasonably foreseeable risks associated with sensory play and voluntarily permits their child to participate.

To the extent permitted by South African law, the parent or guardian agrees not to hold Little Mess Makers liable for harm arising solely from the ordinary, inherent risks of participation where Little Mess Makers has not acted negligently or unlawfully.

Nothing in this agreement excludes liability for gross negligence or removes any rights or remedies that cannot lawfully be excluded under the Consumer Protection Act or other applicable legislation.

6. Health and Safety

Parents agree to follow all safety guidelines and instructions provided by Little Mess Makers.

Little Mess Makers reserves the right to stop an activity or refuse continued participation where necessary to protect the safety of children and other attendees.

7. Emergency Assistance

In the event of an emergency, Little Mess Makers may contact emergency services and assist in obtaining appropriate medical attention where reasonably necessary.

Parents or guardians remain responsible for providing accurate emergency contact information.

8. Parental Consent

By electronically accepting this form, I confirm that:

  • I am the child’s parent or legal guardian, or have the necessary authority to consent.

  • I have read and understood the risks and conditions outlined above.

  • I consent to my child’s participation in Little Mess Makers activities.

  • I understand my responsibility to supervise my child.

  • I have had an opportunity to review this agreement before booking and payment.
